Code § 55-2-12(b)) Courts: Circuit Court of Kanawha County (Charleston), Circuit Court of Cabell County (Huntington) West Virginia allows two years for a personal-injury claim (W. Va. Code § 55-2-12(b)) and two years after the death for a wrongful-death claim (§ 55-7-6(d); the right of action is created by § 55-7-5). For asbestos specifically, accrual is governed by the Asbestos and Silica Claims Priorities Act: W. Va. Code § 55-7G-9 sets out the limitation rule and a two-disease rule, under which a claim for a nonmalignant asbestos condition is a separate cause of action from a later asbestos cancer claim, so resolving the first does not bar the second.
